Agreement to Terms

By downloading, installing, or using Socialmesh ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Socialmesh. Please read them carefully before using the App.

Description of Service

Socialmesh is a mobile application that enables communication over Meshtastic mesh radio networks. The App allows you to:

• Send and receive messages over mesh networks
• View and manage mesh network nodes
• Configure connected Meshtastic radio devices
• Access maps and location features for mesh networking
• Create and share automations, widgets, and signals
• Purchase optional premium features to enhance your experience

The App is designed to work offline. Certain optional features (such as cloud sync, image sharing, and social profiles) require an internet connection and may depend on third-party services described in these Terms.

License Grant

Subject to your compliance with these Terms, Socialmesh grants you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use.

This licence does not include the right to:

• Modify, reverse-engineer, decompile, or create derivative works of the App
• Distribute, sublicence, lease, or lend the App to third parties
• Remove or alter any proprietary notices, labels, or branding in the App
• Use the App for any commercial purpose without prior written consent

All rights not expressly granted in these Terms are reserved by Socialmesh. The App and all copies remain the property of Socialmesh at all times.

Use of the Service

Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any illegal activity or to facilitate unlawful conduct
• Transmit harmful, threatening, abusive, harassing, defamatory, or obscene content
• Interfere with or disrupt the mesh network, other users, or connected devices
• Attempt to gain unauthorised access to any systems, networks, or devices
• Use the App in any manner that could damage, disable, or impair it
• Use automated tools, bots, or scripts to interact with the App in unintended ways
• Impersonate another person or entity on the mesh network

Radio and Legal Compliance

The App is designed for use with radio devices that operate on frequencies regulated by government authorities. You are solely responsible for the lawful operation of any radio equipment used with the App.

Specifically, you acknowledge and agree that:

• You will ensure your radio equipment is legally permitted in your jurisdiction before operating it
• You will operate only within frequency bands, power limits, and duty cycles permitted by your local regulatory authority (for example, ACMA in Australia, FCC in the United States, OFCOM in the United Kingdom, or your local equivalent)
• You will obtain any amateur radio licences, permits, or authorisations required in your jurisdiction before transmitting
• You will not use the App or connected devices to interfere with emergency communications, licensed services, or other radio users
• You will comply with all applicable laws regarding the content of radio transmissions
• You will not operate radio equipment in restricted areas (such as airports, hospitals, or government facilities) where prohibited

Socialmesh does not verify, monitor, or enforce compliance with radio regulations. The App does not control radio hardware or firmware behaviour. Violations of radio laws may result in fines, equipment seizure, or criminal penalties imposed by your local regulatory authority. Socialmesh is not responsible for any consequences arising from your use of radio equipment.

Payments, Subscriptions, and Refunds

Premium Features

The App offers optional in-app purchases ("Premium Features") including:

• Theme Pack
• Ringtone Pack
• Widget Pack
• Automations Pack
• IFTTT Integration Pack

Payment Processing

All purchases are processed through the Apple App Store or Google Play Store. By making a purchase, you agree to the payment terms of the respective platform. Socialmesh does not directly collect or store your payment information.

Subscriptions

If the App offers subscription-based features:

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage or cancel subscriptions at any time through your Apple or Google account settings
• If a billing attempt fails, your access to subscription features may be suspended until the payment issue is resolved
• We may change subscription pricing with reasonable advance notice; continued use after a price change constitutes acceptance of the new price

Refunds

All purchases are final and non-refundable, except as required by applicable law or the refund policies of the Apple App Store or Google Play Store. To request a refund, please contact Apple or Google directly through their standard refund process.

Restoring Purchases

You may restore previously purchased Premium Features on the same platform account at no additional cost using the "Restore Purchases" option in the App.

Intellectual Property

The App and its original content, features, and functionality are owned by Socialmesh and are protected by international copyright, trademark, and other intellectual property laws.

The Socialmesh name, logo, and related marks are trademarks of Socialmesh. You may not use these marks without prior written permission.

Privacy Policy

Our Privacy Policy is incorporated into these Terms by reference. By agreeing to these Terms, you also acknowledge and accept the practices described in our Privacy Policy.

In the event of a conflict between these Terms and the Privacy Policy regarding the handling of your information, the Privacy Policy shall prevail on matters of data handling.

Third-Party Services and Dependencies

The App relies on or integrates with third-party services. Your use of these services is subject to their own terms and privacy policies:

• Apple App Store / Google Play Store — App distribution, payments, and purchase management are governed by the respective platform's terms of service.
• RevenueCat — We use RevenueCat to manage in-app purchases and subscriptions. RevenueCat Terms
• Firebase Crashlytics — We use Firebase Crashlytics for anonymous crash reporting to improve app stability. No personal data or message content is included in crash reports. Firebase Terms
• Meshtastic Firmware and Hardware — The App communicates with Meshtastic radio devices. Socialmesh is an independent project and is not affiliated with the Meshtastic project. We are not responsible for the firmware, hardware, or their behaviour. meshtastic.org
• OpenSky Network — The Sky Scanner feature uses the OpenSky Network API to retrieve live flight position data for scheduled flights. This is a third-party service with its own terms and rate limits. OpenSky Network Terms

We are not responsible for the availability, accuracy, or reliability of third-party services. Outages, changes, or discontinuation of third-party services may affect App functionality, and we shall not be liable for any resulting disruption.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We do not guarantee that the App will be uninterrupted, secure, error-free, or compatible with all devices or radio hardware.

We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use of the App is at your own risk.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SOCIALMESH, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Loss of data, messages, or communications
• Damage to radio equipment or connected devices
• Fines or penalties arising from radio frequency violations
• Interruption of mesh network services
• Reliance on information provided through the App

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App or any Premium Features in the 12 months preceding the claim, or AUD $50, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless Socialmesh and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any applicable radio frequency regulations, licensing requirements, or laws governing the operation of radio equipment
• Content you transmit over mesh networks using the App
• Your violation of any third-party rights

Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms or if required by law.

You may stop using the App at any time by uninstalling it from your devices.

Upon termination:

• Your licence to use the App ends immediately
• You must stop using the App and delete all copies from your devices
• Any Premium Features you have purchased remain tied to your Apple or Google account and may be restored if you reinstall the App in the future
• Provisions that by their nature should survive termination will remain in effect, including Disclaimers, Limitation of Liability, Indemnification, and Governing Law

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia, without regard to its conflict-of-law principles.

Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Melbourne, Victoria, Australia.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

Changes to Terms

We may update these Terms from time to time to reflect changes in the App, our practices, or legal requirements.

When we make changes:

• We will update the "Last Updated" date at the top of this page
• For material changes, the App will prompt you to review and accept the updated Terms before continuing to use the App
• Continued use of the App after the updated effective date constitutes your acceptance of the revised Terms

If you do not agree to the updated Terms, you should stop using the App. Your continued use of the App following any changes indicates your acceptance of the new Terms.
