Agreement to Terms

By downloading, installing, or using Socialmesh ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Socialmesh is a mobile application that enables communication over Meshtastic mesh radio networks. The App allows you to:

  • Send and receive messages over mesh networks

  • View and manage mesh network nodes

  • Configure connected Meshtastic radio devices

  • Access maps and location features for mesh networking

Use of the Service

Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App for any illegal activity

  • Transmit harmful, threatening, abusive, or harassing content

  • Interfere with or disrupt the mesh network or other users

  • Attempt to gain unauthorized access to any systems or networks

  • Use the App in any manner that could damage or impair it

Radio Regulations

Use of Meshtastic radio devices is subject to local radio frequency regulations. You are responsible for:

  • Ensuring your radio equipment is legal in your jurisdiction

  • Operating within permitted frequency bands and power limits

  • Obtaining any required licenses or permits

  • Complying with all applicable radio communication laws

In-App Purchases

Premium Features

The App offers optional in-app purchases ("Premium Features") including:

  • Theme Pack

  • Ringtone Pack

  • Widget Pack

  • Automations Pack

  • IFTTT Integration Pack

Payment

All purchases are processed through the Apple App Store or Google Play Store. By making a purchase, you agree to the payment terms of the respective platform.

Non-Refundable

All purchases are final and non-refundable, except as required by applicable law or the policies of the Apple App Store or Google Play Store.

Restoring Purchases

You may restore previously purchased Premium Features on the same platform account at no additional cost.

Intellectual Property

Our Rights

The App, including its design, features, and content, is owned by Socialmesh and is protected by copyright, trademark, and other intellectual property laws.

Your Rights

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

Open Source

Portions of the App may include open-source software. Such software is subject to its respective open-source licenses.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We do not warrant that:

  • The App will be uninterrupted or error-free

  • Mesh network communications will be delivered

  • The App will meet your specific requirements

  • Any errors will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOCIALMESH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

This includes, but is not limited to:

  • Failed or delayed message delivery

  • Loss of data

  • Radio equipment damage or malfunction

  • Violations of radio regulations

Indemnification

You agree to indemnify and hold harmless Socialmesh from any claims, damages, losses, or expenses arising from:

  • Your use of the App

  • Your violation of these Terms

  • Your violation of any applicable laws or regulations

  • Your content transmitted over the mesh network

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the mesh network.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
